Terms & Conditions

Welcome to Cushion Cottage, these terms and conditions apply to the use of this website and by accessing Cushion Cottage's website and placing an order you agree to be the terms and conditions set out below:

Placing an order

When you select products you wish to purchase they will be added to your shopping cart. When you are ready to place your order your will be directed through the checkout process at which point you can choose checkout using the Paypal Gateway.  To place your order press the "Place Order" button at the checkout, at this point you will be obliged to make your payment. If you select pay by Paypal you will be directed to the Paypal payment gateway.

Order acceptance

Once we receive your order we will send you an order confirmation email detailing the products you have ordered, this does not determine our acceptance of the contract. Once products are dispatched from Cushion Cottage you will be notified by email and this will indicate the completion of a contract between you and us. This contract will be concluded in English.

Prior to dispatch we may cancel your order as a result of one of the following:

  • The product you ordered is not in stock.
  • The identification of a pricing or product description error.
  • A fraudulent transaction has been identified.
We will contact you via email if your order has been cancelled owing to one of the reasons above.
 
Your order will normally be dispatched within 3 working days unless you have chosen to have something made to order then you will receive the item anytime up to 3 weeks unless otherwise stated.
 
If your order has been dispatched you will have 14 days to cancel your order starting from the day after you have received your order. Please see our returns policy.

Pricing

All prices are in pounds sterling.

Product prices and delivery charges are liable to change at any time, however, changes will not affect orders where we have sent you a dispatch confirmation email.

In the case of a pricing error we reserve the right to cancel any order that has not been dispatched.

Availability of Products

All products are subject to availability. In the unlikely event your goods are unavailable we will contact you by phone or email at the earliest opportunity prior to despatching your order.

Description of Products

We will take all reasonable care to ensure that all details, descriptions and prices of products on the website are correct. Although we aim to keep the website as up to date as possible, the information including product descriptions appearing on the website may not always reflect the position exactly at the moment you place an order. As each item is handmade there may be very slight variations in the final product.

Payment

All payments are made through the Paypal Payment Gateway, we do not hold any debit or credit card details on our website or servers, for this reason we are unable to take credit or debit card payments over the phone.

Dispatch

Your order will normally be dispatched within 3 working days unless you have chosen to have something made to order then you will receive the item anytime up to 3 weeks unless otherwise stated.

Reservation of Title

The risk of the products passes to the buyer upon delivery from the carrier but the title in the products remain vested in us and ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges. 

Inspection

You should inspect the products upon receipt and check that everything is included. You will be deemed to have accepted the order unless you notify us upon receipt that there is a problem or you cancel your order in accordance with your cancellation right and / or you return the products in accordance with our returns policy and procedure. If you fail to take such action, we are not obligated to accept any rejection by you of the products at a later date.

Returns Policy

We really hope that you are totally delighted with your purchase from Cushion Cottage. When you buy goods from us, in law you have a number of rights as a consumer. These include the right to claim a refund, replacement, repair and/or compensation where the goods are faulty or described incorrectly. Please contact us in the first instance so that we can do our best to help - our aim is to always have happy customers!

In addition to your own legal rights, we also allow you to return goods if you simply change your mind. Please use the 'contact us' form in the first instance to inform us that you wish to return your item. You will need to return the unused goods to us within 28 days of purchase and we will offer you an exchange or a credit note.

There are some conditions to this policy:

  • You must have purchased the goods directly from Cushion Cottage 
  • We have received the goods back within 28 days of purchase
  • You will be required to pay return postage.  We will reimburse you for postage paid at time of purchase if the goods are damaged/faulty. If you have changed your mind about your purchase we will not refund any postage costs.
  • Goods need to be returned unused and in their original condition and packaging.

It is important to obtain proof of postage from the Post Office when you return a parcel to us. If a returned parcel goes missing we will require this proof prior to issuing a refund.

These works are protected by copyright laws and all such rights are reserved. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission. You may not modify, delete, distribute or post anything on this website for any purpose.

If you post comments on the products to any website, blog or social media network you must ensure that such Commentary represents your fairly-held opinions.

Limitation of liability

No liability will be accepted for any injury loss or damage suffered as a result of the use of Cushion Cottage's website or any products supplied by Cushion Cottage.
